I continue to do research into the licensing issues around Open Battle Gaming™ and the use of the Open Game License. I believe that my previous lawyer was not skilled enough to make a valid evaluation of the situation. I have located a new lawyer and I am now putting together the as much background information on the subject (this saves money with the lawyers).
I spent significant time searching the internet for references to OGL and who were using it. I found that there is at least one company that is using it to license a game that is not based on the Wizards 3.5 System. I read and reread the text and it appears that the license is generic enough to do this.
I then search all the case law databases for references to OGL. I found that there is no case law at the state or federal law involving this license. That would indicate that if any suits have been filed they have been settled out of court.
The deadlines are looming to get Open Battle Gaming™ out the door, so there will be a decision soon.
